These Terms of Service (“Terms”) govern your use of Next Up at playnextupgame.com (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Your account

You may sign in using your Google account. You are responsible for activity that happens under your account and for keeping your Google account secure. Let us know right away if you believe your account has been used without permission.

• Break the law or violate anyone else’s rights while using the Service
• Cheat, exploit bugs, or use bots, scripts, or automation to play or to collect data
• Interfere with, overload, or try to gain unauthorized access to the Service or its systems
• Copy, resell, or redistribute the Service or its puzzles without permission
• Impersonate others or submit offensive or harmful content

We may suspend or terminate accounts that violate these Terms.

Our content

The Service, including its puzzles, design, text, graphics, and code, is owned by Next Up and protected by intellectual property laws. We give you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial enjoyment.

If you send us ideas or suggestions, we may use them without any obligation to you.

Privacy

Our Privacy Policy explains how we collect and use information. By using the Service, you also agree to it.

Changes and availability

We may change, pause, or discontinue any part of the Service at any time. We may update these Terms; when we do, we will change the “Last updated” date. Continuing to use the Service after changes means you accept the updated Terms.

To the fullest extent permitted by law, Next Up and its creators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the past 12 months or $50.

Termination

You may stop using the Service at any time and may ask us to delete your account. We may suspend or end your access if you violate these Terms or if we discontinue the Service.

Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Utah, and you consent to their jurisdiction.
